Terms of Service — PsychoProfil.pl

§ 1. General Provisions

  1. These Terms of Service govern the use of the PsychoProfil.pl website (hereinafter: "Service"), available at www.psychoprofil.pl.
  2. The Service is operated by the Operator — a natural person conducting business activity registered in Poland (hereinafter: "Operator"). Contact: kontakt@psychoprofil.pl.
  3. Using the Service constitutes acceptance of these Terms. Users who do not accept the Terms should discontinue use of the Service.
  4. These Terms are made available free of charge on the Service website in a manner that allows them to be retrieved, reproduced, and stored.

§ 2. Definitions

  • User — any natural person using the Service, whether without registration (Guest) or after creating an account (Registered User).
  • Account — an individual User account in the Service, created by providing an email address and logging in via a magic link.
  • Test — a psychometric questionnaire available in the Service, based on scientific instruments in the public domain.
  • Result — an automatically generated interpretation of the User's answers to Test questions.
  • Subscription — a paid service providing access to premium features (unlimited tests, PDF reports, results history).
  • One-time Purchase — a paid service granting access to a single premium Test and PDF report.

§ 3. Nature of the Service — Medical Disclaimer

  1. All Tests, Results, and content in the Service are intended solely for educational and entertainment purposes.
  2. The Service does not constitute a clinical, psychiatric, or medical diagnosis and is not a substitute for consultation with a qualified professional — psychologist, psychiatrist, or other healthcare provider.
  3. Test Results should not be used to make medical, professional, or life decisions without consulting an appropriate specialist.
  4. The Operator is not liable for decisions made by the User on the basis of Test Results.

§ 4. Rules of Use

  1. The Service may be used without registration (free tests) or after creating an Account (premium features).
  2. The User agrees to use the Service in accordance with applicable law, these Terms, and good practices.
  3. The following are prohibited: (a) providing false information during registration; (b) sharing the Account with third parties; (c) automated data collection from the Service (scraping); (d) attempting to bypass technical security measures.
  4. The Operator reserves the right to suspend or terminate an Account that violates these Terms.

§ 5. Registration and Account

  1. Registration is completed by providing an email address. Login is performed via a magic link sent to that address — no password is required.
  2. The User is responsible for keeping their email address current.
  3. The User may delete their Account at any time by contacting privacy@psychoprofil.pl. Deletion of the Account results in permanent removal of personal data and Results history.

§ 6. Tests and Results

  1. The Service provides Tests based on scientific instruments in the public domain (including IPIP Big Five, Rosenberg SES, Holland RIASEC, GAD-7, Schwartz PVQ-21).
  2. Free Tests may be taken without registration. Results of free tests are displayed immediately and are not saved to the server unless the User is logged in.
  3. Premium Tests require an active Subscription or One-time Purchase.
  4. Results of logged-in Users are stored to enable access to Results history and PDF report generation.
  5. The Operator reserves the right to add new Tests, modify existing ones, and change the classification of tests as free or premium.

§ 7. Payments and Subscriptions

  1. Payments are processed by LemonSqueezy LLC as Merchant of Record. LemonSqueezy is responsible for: payment processing, EU VAT handling, PSD2/SCA compliance, refunds, and chargebacks.
  2. The Operator does not store payment card data or Users' banking information.
  3. Available subscription plans: (a) Monthly — 49 PLN/month; (b) Yearly — 399 PLN/year. Current prices are available on the Pricing.
  4. Subscriptions renew automatically at the end of each billing period unless cancelled by the User.
  5. The User may cancel their Subscription at any time. Cancellation takes effect at the end of the paid period.
  6. A One-time Purchase (9 PLN) grants permanent access to a single premium Test and PDF report.
  7. Right of withdrawal: Consumers have the right to withdraw from the contract within 14 days of purchase, unless the service has been fully performed (the Test has been completed and the Result generated) — in accordance with Article 38(1) of the Polish Consumer Rights Act.

§ 8. Intellectual Property

  1. The Service content (graphic layout, texts, software) is the property of the Operator and is protected by copyright law.
  2. The psychometric instruments used in the Tests are in the public domain or used under free scientific use licences.
  3. Users may use their Test Results for personal use. Copying and distributing Service content without the Operator's consent is prohibited.

§ 9. Personal Data

  1. The data controller for personal data is the Operator.
  2. Data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

§ 10. Liability and Limitations

  1. The Operator makes every effort to ensure the Service operates correctly and without interruption, but does not guarantee continuous availability.
  2. The Operator is not liable for: (a) damages arising from the User's interpretation of Test Results; (b) interruptions in access to the Service caused by force majeure or maintenance work; (c) actions of third parties (e.g. hosting service providers).
  3. The Operator's maximum liability to the User is limited to the amount paid by the User for services in the preceding 12 months.

§ 11. Complaints

  1. Complaints may be submitted electronically to: kontakt@psychoprofil.pl.
  2. A complaint should include: (a) the User's email address; (b) a description of the issue; (c) the expected resolution.
  3. Complaints will be resolved within 14 days of receipt.

§ 12. Amendments to the Terms

  1. The Operator reserves the right to amend these Terms. Users will be notified of changes via the Service or by email (if they hold an Account).
  2. Amendments take effect 14 days after publication of the revised Terms.
  3. Continued use of the Service after amendments take effect constitutes acceptance of the revised Terms.

§ 13. Final Provisions

  1. These Terms are governed by Polish law.
  2. Any disputes shall be resolved by the court having jurisdiction over the Operator's registered seat, subject to consumers' statutory rights under applicable law.
  3. Consumers have the right to use out-of-court dispute resolution methods, in particular through the EU ODR platform: ec.europa.eu/consumers/odr.
  4. These Terms enter into force on 22 March 2026.
